2024 Second Extraordinary and Regular sessions of the Louisiana Legislature
LAJ staff compiled this summary of selected bills enacted during the 2024 Second Extraordinary and Regular sessions of the Louisiana Legislature. Art. 3, Sect. 19 of the Louisiana Constitution specifies that the effective date of an act of the regular session shall be August 1 of the calendar year in which the session was held, unless the instrument itself specifies a different effective date. You should see the act for any specific language concerning proposed prospective or retroactive application. If no such language exists, courts will perform retroactivity analysis under Civil Code art. 6 and R.S. 1:2.

2024 Second Extraordinary Session: Convened February 19 (Governor’s Proclamation No. 13 JML 2024 to address crime issues). Adjourned February 29. Legislators limited to filing and debating bills that fall within the 24 items included in the governor’s call. Instruments filed: 48 bills (23 House/15 Senate), 3 resolutions.
2024 Regular Session: Convened March 11. Adjourned June 3. Even-numbered years are “general” sessions. No matters involving state taxes or tax exemptions, exclusions, deductions, or credits could be considered. Instruments filed: 1,491 bills (982 House/509 Senate), 42 constitutional amendments, 771 resolutions and study requests.

Two-year prescription. Enacts C.C. art. 3493.11 that provides delictual actions are subject to a liberative prescription of two years. Enacts C.C. art. 3493.12 establishing two-year prescription for damage to immovable property. Prospective only. (Adds C.C. arts. 3493.11 and 3493.12; repeals C.C. arts. 3492 and 3493) HB 315 Mike Johnson. Act 423. Effective July 1, 2024
Direct action. Revises direct action and nonjoinder statute R.S. 22:1269. Limits direct action lawsuits by preventing insurers from being named in initial lawsuits, except in limited circumstances. Exceptions: a) insured files for bankruptcy, b) insured is insolvent, c) service on the insured has been attempted without success or the insured refuses to answer or otherwise defend the action within 180 days of service, d) actions between children and their parents or between married persons, e) uninsured motorist actions, f) insured is dead, and g) the insurer is defending under reservation of rights or denies coverage, but only for the purpose of establishing coverage. Prohibits a court from disclosing insurance coverage to a jury unless required to by evidentiary laws (C.E. 411; repeals C.E. 411(D)). Provides that the filing against the insured interrupts prescription against all insurers. Prohibits insurer from being named in the caption. Provides for serving the citation on the non-party insurer. Permits counsel for the insured to certify that the insurer waives any further notice except through counsel. At the time a judgment is entered or settlement is reached during the litigation, the liability insurer may be joined as a party defendant for the purposes of enforcing the judgment or settlement. Requires insurer to disclose any coverage defenses within 90 days of determination, in no case later than 30 days before trial. Allows plaintiff to resolve a claim of coverage against one insurer while preserving a claim against another insurer of the same defendant in the cause of action as contemplated by Gasquet and its progeny. Offer of judgment. Requires an offer of judgment to include an opportunity for adequate discovery. Allows defendant-offeror to obtain costs if the final judgment is in its favor. (Amends C.C.P. art. 970(A) and (C)) SB 84 Seabaugh. Act 502. Effective August 1, 2024
Prescription: child sex abuse. Extends the window to file an action related to past sexual abuse of a minor for actions that had previously passed the prescription deadline. Changes deadline from June 14, 2024, to June 14, 2027. (Amends Section 2 of Act 386 of 2022 R.S.) SB 246 Luneau. Act 481. Effective June 14, 2024; HB 803 Muscarello. Act 789; SCR 26 Luneau.
Repeals single-business-enterprise doctrine. Legislatively overrules Green v. Champion Ins. Co., 577 So. 2d 249 (La. App. 1 Cir. 1991) in favor of a traditional, veil-piercing analysis. (Adds R.S. 12:1705) SB 10 Pressly. Act 277. Effective August 1, 2024
Civil procedure. Law Institute revisions to the Code of Civil Procedure. C.C.P. art. 863. Signing of pleadings. Adds that a party or attorney may sign a pleading by electronic signature in accordance with Article 253. C.C.P. art. 1425. Experts; pretrial disclosures; scope of discovery. Requires a party seeking to challenge whether a witness qualifies as an expert or whether the methodologies employed are reliable under the Code of Evidence to file a motion for a pretrial hearing (legislatively overrules Williams v. State Farm, 322 So. 3d 795, 797 (La. App. 1 Cir. 2021)). C.C.P. art. 2163. Peremptory exception filed in appellate court; remand if prescription or peremption pleaded. Adds peremption to prescription as grounds where plaintiff may demand that the case be remanded to the trial court for trial of the exception. C.C.P. art. 3335. Notice to heirs and residuary legatees. Adds that service may be made on a resident or a nonresident by use of a commercial courier that requires a signed receipt from the addressee upon completion of delivery. Remote technology. Allows a party in any civil proceeding that does not require witness testimony or the introduction of evidence to provide written notice to the court at least 10 days prior to the scheduled hearing date that he will appear remotely. Requires the court to allow the party to appear by any audiovisual means, unless the court provides written reasons declining the remote appearance for good cause. (Amends C.C.P. art. 195.1) HB 969 Green. Act 463. Effective August 1, 2024
Electronic filing. Law Institute. Provides for electronic filing and record retention. (Amends C.C.P. arts. 253 and 2853, C.Cr.P. art. 14.1, and R.S. 44:116(D) and (E)(1) and (2); adds C.C.P. art. 2911, C.Cr.P. art. 14.2, R.S. 9:2761 and 2762, and R.S. 44:117; redesignates C.C.P. art. 258 and R.S. 44:117) SB 75 Morris. Allows for service of process by commercial courier for a petition for appointment as curator for an absent person. (Amends R.S. 13:3425(B) and C.C.P. art. 5094) HB 21 Melerine. Act 183. Effective August 1, 2024
Allows for service of process by commercial courier for a subpoena for medical records. (Amends R.S. 13:3715.1(B)(1)) HB 27 Melerine. Act 185. Effective August 1, 2024
Defines “noticeable violation” of building restrictions for the two-year prescriptive period. (Amends C.C. art. 781) HB 23 Melerine. Act 184. Effective August 1, 2024
Eviction. Removes the jurisdictional amounts for eviction proceedings in city and parish courts. (Amends C.C.P. art. 4844 and R.S. 13:1443(B)) HB 100 Carlson. Act 129. Effective August 1, 2024
Tort filing form. Repeals civil case cover sheet and $10 filing fee charged when a suit is filed in district court for damages arising from an offense or quasi offense. (Repeals R.S. 13:4688) HB 104 Muscarello. Act 15. Effective May 8, 2024
Evidence. Law Institute. Amends C.E. art. 702(A) and (4), testimony by experts. Clarifies the burden of proof and makes semantic changes consistent with Rule 702 of the Federal Rules of Evidence. (Amends C.E. art. 702(A) and (4)) SB 16 Pressly. Act 88. Effective August 1, 2024
Interpreter. Law Institute. Requires the appointment of an interpreter to be made in accordance with the Code of Evidence and the Rules of the Louisiana Supreme Court. Provides for qualifications of court-appointed interpreters, voir dire examinations, exceptions and objections, and recordation and retention of interpreted communications. (Amends C.C.P. art. 192.2, C.Cr.P. arts. 25.1 and 433(A) and (C), and C.E. art. 604; adds C.E. art. 604.1) SB 103 Duplessis. Act 32. Effective August 1, 2024
Venue. Removes the requirement that actions against foreign or alien insurers be brought in East Baton Rouge Parish. (Repeals C.C.P. art. 42(7). Note: HB 88 sections 1 and 2 repealed by HB 803/Act 789) HB 88 Melerine. Act 595. Effective August 1, 2024
Provides for a determination of venue for a foreign entity in certain circumstances. Provides an effective date of June 14, 2024, for SB 246/Act 481 of 2024 R.S. (Amends C.C.P. arts. 42(5) and (6); repeals Sections 1 and 2 of HB 88/Act 595 of 2024 R.S.) HB 803 Muscarello. Act 789. Effective: See act.
Litigation funding. Enacts the Transparency and Limitations on Foreign Third-Party Litigation Funding Act. Addresses litigation finance by foreign governments and third-party funding of lawsuits to “defray litigation expenses” or “impact of a negative judgment.” Defines third-party litigation funder. Excludes funding by parties, lawyers, cost of living or other personal or familial expenses; contingency contract; for medical services, direct loans, and certain nonprofits. Requires disclosure reports to the attorney general. Allows attorney general to institute a legal action to enforce compliance, impose fines, or prohibit foreign third-party litigation funder from operating within this state. Prospective. (Adds R.S. 9:3580.1-3580.12) SB 355 Stine. Act 765. Effective August 1, 2024
UM. Addresses selection or refusal of uninsured motorist coverage when purchasing car insurance. Modifies the rebuttable presumption of coverage. Private passenger (opt-out): Provides that if the form is signed but not properly completed to create a rebuttable presumption that the insured knowingly rejected coverage, then uninsured motorist coverage or modified uninsured motorist coverage will not be provided, as applicable, if it is determined that the insured intended to reject or modify the uninsured motorist coverage. Commercial (opt-in): Authorizes the insured to select uninsured motorist coverage for commercial policies. Provides that if there is no selection of uninsured motorist coverage on the form provided to the insured and no payment of premium that includes the coverage, it will be presumed that uninsured motorist coverage was not elected for that policy or contract. UM. Requires insurers to verify proper completion and retain a copy of the uninsured motorist form for rejection of coverage. Applies to new policies written on or after April 1, 2025. (Amends R.S. 22:1295(1)(a)(ii)) HB 511 Illg. Act 381. Effective: See act.
Mandates that insurers who write homeowners or motor vehicle insurance must disclose all discounts that could reduce a policyholder’s premium. Failure to comply does not create a cause of action. Does not apply to excess and surplus lines. (Adds R.S. 22:881.1) HB 375 Landry. Act 611. Effective May 1, 2025
Extends a 25 percent discount for car insurance premiums to military reservists, retired military, and disabled veterans. (Amends R.S. 22:1482(A), (B), and (C)(1)) SB 337 Boudreaux. Act 173. Effective January 1, 2025
Allows a car owner whose vehicle is registered in this state to show a valid motor vehicle liability policy issued from another state to satisfy requirements for proof of financial responsibility. (Adds R.S. 32:900.2) HB 430 Owen. Act 696. Effective August 1, 2024
Requires all charter captains to have commercial marine insurance coverage. Establishes a fine of at least $1,000 for a first-offense violation. (Amends R.S. 56:302.9(A)(1) and (2) and (J)(1); adds R.S. 56:301.10(B)(10) and (11)) HB 661 Bryant. Act 442. Effective August 1, 2024
Bad faith. Streamlines bad faith statutes, claims process; details the duties of good faith and fair dealing for the insurance company and customer. R.S. 22:1973 was repealed. R.S. 22:1892 was split into 22:1892 for non-catastrophic claims and 22:1892.2 for catastrophic property loss claims. Changes to 22:1892 modify the time lines for when insurance companies: (1) must initiate loss adjustment, (2) must pay the undisputed claim amount, (3) can be sued for bad faith. Creates a new cure period to resolve disputes pre-suit. Requires that satisfactory proof of loss be a written document. Penalties are either $2,500, $5,000, or 50 percent of the damages sustained, whichever is greater. Provides “proven economic damages” as an additional penalty. Maintains recovery of attorney fees and costs. Prescription is two years. (Amends R.S. 22:1892(A)(3) and (4), (B)(1), and (H); adds R.S. 22:1892(A)(7), (B)(7), (I), (J), and (K) and 1892.2; repeals R.S. 22:1973) SB 323 Talbot. Act 3. Effective July 1, 2024
Citizens. Adds certain exemptions for damages and penalties for Louisiana Insurance Guaranty Association and Louisiana Citizens Property Insurance Corporation for property claims. LIGA not liable for penalties or special damages. Citizens not liable for general damages, special damages, or penalties in excess of the policy’s limit. Maintains legal interest and attorney fees that are not included in excess language. Suspends the 10 percent surcharge for rates for policies from Citizens in all parishes for three years from January 1, 2025, through December 31, 2027. (Amends R.S. 22:1892(H), 1892.2(F), and 2303(D)(1); adds R.S. 22:2303(D)(6)) SB 113 Talbot. Act 757. Effective: See act.
Citizens. Allows policyholders the option to limit or exclude coverage of personal property within insurable property. (Amends R.S. 22:2292, 2322, and 2336) HB 428 Boyd. Act 401. Effective August 1, 2024
Appraisal. Addresses claim disputes when insurers and consumers disagree on the amount of loss the company should cover. Allows both parties to hire an independent appraiser. If these appraisers still do not agree, an impartial umpire can be assigned. Applies to the policies of property insurance issued, delivered, or renewed on or after January 1, 2025. (Amends R.S. 22:821(B)(34), 1311(F)(2), 1807.1-1807.27, and 1892(G)) HB 609 Firment. Act 625. Effective August 1, 2024
Fraud. Adds to definition of fraudulent insurance act, a person’s presentation of a statement, estimate, invoice, or other related document to an insurer or insured that misrepresents the scope of damages or costs of repairs associated with a property insurance claim. (Amends R.S. 22:1923 and (2), 1964(13), and 2198(A); adds R.S. 22:1923(2)(p)) HB 651 Braud. Act 389. Effective August 1, 2024

Allows homeowners insurers to use aerial images to inspect property as long as the images were taken within the last 24 months. (Adds R.S. 22:1339) SB 242 Bouie. Act 151. Effective May 22, 2024
Unfair trade practices. Adds an insurer’s failure to give a requesting insured the original field adjuster’s repair estimate and failure to identify the person who made any revisions as unfair claims settlement practices. (Adds R.S. 22:1964(14)(q)) HB 520 Firment. Act 113. Effective August 1, 2024
Homeowners insurance. Provides a grace period of up to 60 days for a surviving spouse to pay the semi-annual or annual premium payment due for a homeowners policy. (Adds R.S. 22:1335(C)-(H)) SB 345 Barrow. Act 175. Effective January 1, 2025
Insurance regulation
Phases out rule that prohibits homeowners insurers from raising deductibles or canceling or not renewing policies in effect more than three years. (Amends R.S. 22:1265(D); adds R.S. 22:1265(K) and (L); repeals R.S. 22:1265(F) and (H) and 1333(C)-(H)) HB 611 Firment. Act 9. Effective: See act.
Updates property and casualty lines to a file-and-use system, allowing new rates and products to take effect upon filing. Louisiana Department of Insurance may disapprove these filings within 30 days. SB 295 Cloud. Act 10. Effective May 7, 2024

Allows the commissioner of insurance to apply for grants or funding to supplement state appropriations and requires the Department of Insurance to annually publish insurer discounts approved thus far and actuarially sound program and discount recommendations. (Amends R.S. 22:1483.1(A) and (C) and R.S. 44:4.1(B)(11); adds R.S.22:1483.1(B)(5) and (E)(3) and 1483.3; repeals R.S. 22:1483.1(F)) SB 484 Duplessis. Act 533. Effective June 10, 2024
Creates the Insurance Regulatory Sandbox Act. Authorizes the commissioner of insurance to grant a variance or waiver with respect to specific requirements of any insurance law, regulation, directive, or bulletin if a person demonstrates that his application would prohibit the introduction of an innovative or more efficient insurance product or service that the applicant intends to offer during the period for which the proposed waiver is granted. Prohibits the commissioner from granting new waivers or extensions after June 30, 2029. Terminates on June 30, 2032. (Adds R.S. 22:1430.1-1430.4) HB 701 Carver. Act 229. Effective May 23, 2024

Bastrop. Increases the civil jurisdictional limit from $15,000 to $25,000 for the City Court of Bastrop. (Amends C.C.P. art. 4843(E)) SB 445 Jackson-Andrews. Act 105. Effective August 1, 2024
Lafayette, Crowley, and Rayne. Increases the civil jurisdictional limit from $20,000 to $35,000 for the City Court of Lafayette. Increases the civil jurisdictional limit from $30,000 to $35,000 for the city courts of Crowley and Rayne. 19th JDC. Authorizes the establishment of the complex litigation section pilot program in the 19th JDC and provides for additional filing fees for complex litigation cases. 25th JDC. Allows judge in the 25th JDC to hold civil and criminal sessions on non-jury matters and summary proceedings at a designated location in Plaquemines Parish west of the Mississippi River. (Adds R.S. 13:501(B)(4)) HB 552 Braud. Act 706. Effective August 1, 2024
Requires the Red River Parish clerk of court to perform the functions of the jury commission in that parish. (Amends C.Cr.P. art. 404(H)) HB 26 Bamburg. Act 108. Effective August 1, 2024
Requires the clerks of court of Ascension, Assumption, and St. James parishes to perform the functions of the jury commission. (Amends C.Cr.P. art. 404(J)) HB 74 Bacala. Act 40. Effective August 1, 2024
Supreme Court districts. Redraws district boundaries for the seven Supreme Court districts and assigns each justice in office to a district. States that the purpose and intent is to statutorily effectuate and implement a settlement reached in Louisiana State Conference of NAACP v. State of Louisiana, 3:19-479, USDC MDLA. (Adds R.S. 13:101.2 and 101.3; repeals R.S. 13:101, 101.1, and 312.4) SB 255 Fields. Act 7. Effective May 1, 2024
Limits access to judges’ personal information. Provides that a person who violates law is guilty of a misdemeanor and on conviction is subject to imprisonment up to 90 days or a fine not exceeding $1,000, or both. Does not apply to a public body. (Adds R.S. 44:11.2) HB 669 Boyd. Act 628. Effective

Commercial vehicle equipment. Limits liability for commercial vehicles that do not install optional equipment. Provides that commercial vehicle owners have no duty to install equipment that is not required by law and that the absence of optional equipment is not admissible to establish the owner’s negligence. Adds livestock to Civil Code art. 2321. Damage caused by animals. Requires owner to exercise reasonable care and provides that the owner of livestock is not liable for damages for injuries to person or property for livestock that escape an enclosure due to a fortuitous event at no fault of the owner or due to third-party provocation of the livestock. (Amends C.C. art. 2321) HB 784 Schamerhorn. Act 252. Effective August 1, 2024
Blocking the road. Limits liability of operators of motor vehicles for harm caused to persons who are injured while illegally blocking a road or highway. Allows operator to use force with his vehicle to retreat or escape from the pedestrian if the operator reasonably believes that he or his passengers are in immediate danger of imminent death, serious bodily injury, or serious bodily harm from the pedestrian illegally blocking a roadway. Does not apply to intentional acts. (Adds R.S. 9:2792.10) HB 383 Galle. Act 612. Effective August 1, 2024
Peace officer. Prohibits civil claims against a peace officer or public entity that employs or appoints a peace officer for conduct or actions that arise out of any discretionary function within the course and scope of the peace officer’s law enforcement duties. (Adds R.S. 9:2793.11) HB 2 (Second Extraordinary Session) Bacala. Act 16. Effective April 29, 2024
Self-defense, concealed carry. Limits liability for persons authorized to carry a concealed handgun for injury suffered by a perpetrator when the injury, death, or loss is caused by a justified use of force or self-defense. Precludes any right of action by the perpetrator, his survivors, or his heirs. Authorized persons include active law enforcement; retired law enforcement; any person with a valid concealed handgun permit; and military personnel who are active, reserve, or retired. (Adds R.S. 9:2793.12) SB 2 (Second Extraordinary Session) Miguez. Act 2. Effective July 4, 2024
Bonfire immunity. Amends bonfire immunity to provide that no person shall have a cause of action against a sponsor unless the sponsor failed to comply with a permit for bonfire presentation, failed to use the proper materials, negligently violated an order from the local authority, or committed a deliberate and wanton act or gross negligence, and the sponsor was the cause in fact of the injuries. Authorizes and gives immunity for the administration of any life-saving medication at schools. (Amends R.S. 17:436.1(M); adds R.S. 17:436.1(O)) HB 456 Davis. Act 378. Effective August 1, 2024
Emergency medication. Allows a health-care professional to prescribe lifesaving medications in the name of a qualified entity. Defines qualified entity as any public or private entity except public or non-public elementary or secondary schools. Allows trained personnel to administer medications to an individual experiencing a medical emergency. Immunity for act or omission associated with administration of a lifesaving medication, unless the result of willful or wanton misconduct. Immunity provided to qualified entity; entity’s employee, agent, or volunteer; licensed health-care professional authorized to prescribe or dispense; and training organization. (Adds R.S. 40:1142) HB 602 Davis. Act 657. Effective August 1, 2024
Hope for Louisiana Patients Law. Allows a manufacturer operating within an eligible facility that complies with federal laws and regulations to make available an individualized investigative treatment to an eligible patient. Provides that there is no private cause of action against a manufacturer of an individualized investigational drug, biological product or device, or against any other person or entity involved in the provision of such care. Public records. Repeals the custodian’s personal liability for the payment of damages for arbitrary and capricious withholding of public records or failure to respond to a public records request. (Amends R.S. 44:35(E)) HB 768 Farnum. Act 493. Effective June 5, 2024
Carbon sequestration. Defines landowner within the Geologic Sequestration of Carbon Dioxide Act and provides that surface and pore space owners are not liable for any claims related to the sequestration of carbon dioxide just because they are landowners or have entered into an agreement for their property to be used for carbon dioxide sequestration. (Amends R.S. 30:1104(A)(10) and 1109(A)(3); adds R.S. 30:1103(14) and 1109.1) HB 937 Geymann. Act 461. Effective August 1, 2024

Licensing. Provides for universal recognition of occupational licenses. Out-of-state occupational license applicants are eligible to receive a license to work as long as the out-of-state license is at a similar scope of practice for at least one year, is in good standing, and the applicant met the testing or training requirements of the initial licensing state. Requires the Louisiana State Board of Medical Examiners and the Louisiana Board of Veterinary Medicine to issue a conditional license or certification, pending normal licensure, to an applicant who otherwise satisfies the requirements. Allows the Louisiana State Board of Dentistry to require an applicant for dental licensure to successfully complete an initial clinical licensure examination in a jurisdiction that includes a hand-skills assessment. Eliminates mandatory tax sales for nonpayment of property taxes and requires the legislature to provide for such procedures by law. It also limits the amount of penalty and interest on delinquent property taxes and allows for the postponement of property tax payments under certain circumstances. (Amends Const. Art. Increases the membership of the Judiciary Commission, allows the Supreme Court to sanction a judge upon an investigation by the Judiciary Commission, and specifies that the recommended sanction be instituted by the Judiciary Commission or a majority of the Supreme Court.
